Guardianship of Minor Children
Ensuring you have a plan on who will care for your minor children if you or your spouse passed is important. If there is a surviving parent, then that parent may have the parental responsibilities for your minor children subject to any Family Court order that may limit their parental power.

If you have minor children, then you may wish to consider nominating in your Will a guardian (and substitute guardian in the event that your original guardian is unable to act) for your minor children to act in the event that there is no surviving parent.

A benefit of appointing in your Will a guardian for your minor children is that you are able to outline any specific wishes you wish the guardians to consider whilst raising your children, for example, the education of your children, the accommodation of your children etc.
If no guardian is appointed under your Will, then the Family Court may have the power to decide where your minor children are going to live and who will make legal decisions on their behalf. This may result in a dispute between your remaining family members.
